These Terms of Use (“Terms”) govern your access to and use of the Equestrian mobile application and associated services (collectively, the “Service” or “Platform”), operated by NPH Holding AS, a company registered in Norway.

By accessing or using the Service, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree with any part of these Terms, you may not access or use the Service.

2. Service Description

Equestrian is a platform that connects individuals and businesses in the equestrian community for the purpose of showcasing, discovering, and promoting horses. The platform enables users to:

  • Create and manage personal or business profiles

  • Post and browse horse listings

  • Communicate via in-app messaging

  • Subscribe to access additional features

Note: Equestrian does not facilitate payments or contracts between users. All transactions take place outside the platform and are the sole responsibility of the buyer and seller.

3. Eligibility

To use the Service, you must be at least 18 years old. By registering, you confirm that you meet this requirement.

4. User Registration & Account Security

To use most features, you must create an account. You agree to provide accurate and up-to-date information and keep it current.

Personal profiles may collect the following data:

  • Name

  • Email address

  • Nickname

  • Profile photo (optional)

  • Date of birth

  • Sex

  • Phone number

  • Zip, City, Street

  • Country

Business profiles may collect:

  • Business name and photo

  • Email and phone number

  • Business address

  • Social media links

  • Business description

Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

5. Subscriptions & Payments

The Service offers both personal and business subscription plans. All plans include a 7-day free trial.

Private User Subscription

  • Access to all core features (listing horses, messaging, browsing)

  • Max 3 active ads

  • Trial: 7 days free

  • Price: $17.99/month after trial

To post more than 3 horses, users must upgrade to a business plan.

Business Subscription

Includes access to premium tools:

  • Unlimited horse ads

  • Branded marketplace for all listings

  • Admin/team access

Pricing:

  • Monthly: €79/month

  • 6 months: €69/month (billed €414 every 6 months)

  • Annual: €59/month (billed €708 annually)

Renewals: All subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.

Subscription management: Users can manage or cancel their plan through their device’s App Store or Google Play subscription settings.

6. Trial Period & Limitations

All plans include a 7-day free trial. Access to features is revoked once the trial ends if no subscription is purchased. Trials are limited to one per user.

7. User Conduct

You agree not to:

  • Post false, misleading, or illegal content

  • Engage in harassment, spam, or abusive behavior

  • Attempt to interfere with platform operations

  • Misuse the messaging system for unsolicited promotions

Violation of these rules may result in suspension or termination of your account.

8. Data Collection & Privacy

Your data is processed according to our [Privacy Policy].

Additional technical data collected includes:

  • Verification codes

  • Messaging history

  • Listings and publication data (title, description, price, breed, age, size, gender, color, pedigree, status, views, seller type, timestamps)

  • Subscription data (start date, status, type, platform, transaction ID, product ID)

We do not sell personal data to third parties.

9. Intellectual Property

All content and technology on the platform, including the name “Equestrian,” is owned by NPH Holding AS. You may not copy, distribute, or use platform materials without written permission.

10. Limitation of Liability

NPH Holding AS is not responsible for:

  • Accuracy or content of listings

  • Transactions or communications between users

  • Damages arising from the use or inability to use the platform

The service is provided “as is” without warranties of any kind.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws. Users may delete their account at any time by contacting support.

12. Modifications to the Terms

We may update these Terms from time to time. Changes will be communicated in-app or via email where appropriate. Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Norway. Disputes shall be settled by Norwegian courts, with Bergen Tingrett as the legal venue unless otherwise required by law.

15. Disclaimer – No Responsibility for Listings, Content, or Transactions

NPH Holding AS provides the Equestrian platform as a digital marketplace where users can create profiles, publish horse listings, communicate, and connect with other users. The platform does not verify, control, or guarantee the accuracy, quality, legality, or completeness of any content posted by users, including but not limited to:

  • horse descriptions

  • images

  • pricing

  • seller information

  • availability

  • any claims made by users

All listings, messages, and profile information are created and controlled solely by the users who publish them.

No involvement in transactions

NPH Holding AS is not a party to any agreements, negotiations, payments, or transactions between buyers and sellers.

All communication, decision-making, and the entire buying or selling process take place directly between the parties involved, and the company:

  • does not participate in any transaction

  • does not mediate disputes

  • does not guarantee payment, delivery, or performance

  • is not responsible for fraud, misunderstandings, or disagreements between users

User responsibility

Users are fully responsible for:

  • verifying the identity, credibility, and intentions of other users

  • inspecting any horse before making a commitment

  • ensuring that agreements comply with applicable laws

  • conducting transactions safely and independently

NPH Holding AS cannot be held liable for any loss, damage, conflict, or claim arising from interactions or transactions between users.
